If you want to use your land as a Caravan Site, even for a single caravan you will need a site licence. The term "caravan" means any structure designed or adapted for human habitation which is capable of being moved from one place to another whether by being towed, or by being transported on a motor vehicle or trailer and any motor vehicle so designed or adapted, it does not include tents. It includes caravans and mobile homes which can be towed behind cars, motor homes, static holiday homes and the more modern residential park homes, which often arrive on site in two sections and are then bolted together.

These regulations set out the more detailed aspects within the framework, including:. The Housing Scotland Act part 5 Act part 5 amended the Caravan Sites and Control of Development Act to establish the framework for the new licensing system.
The new part 1A deals with the licensing of relevant permanent sites in Scotland and came into effect for new sites from 1 May It must be read together with the regulations above.
Transitional arrangements under section 83 of the Act allow those who already hold an existing licence until 1 May to apply for a new Part 1A licence although to ensure sites remain fully licensed there an assumption that site owners will start the application process well before the expiry date ends. It amends Schedule 1 to the Act, which was also amended by section of the Housing Scotland Act They offered a new and version of the written statement, which reflects the amendments the Order would make to the implied terms in Schedule 1.
They came into effect in September The Mobile Homes Act gave security of tenure to residents of mobile home sites who own the home in which they live and who rent the pitch from the site owner. As with the Act, the Act only covers owners and occupiers of protected sites.
This Act placed an obligation on the site owner to maintain the site and gave them a right to claim commission on the sale of homes stationed on the site. The Caravan Sites Act gave basic protection to all mobile home occupiers living on land for which the owner has planning permission and is entitled to obtain a site licence. It aimed to prevent site owners from evicting occupiers with residential contracts other than by obtaining a court order.
The Caravan Sites and Control of Development Act is the founding legislation which still governs the caravan site licensing regime.
Although heavily amended since, much remains in force. The Act required site owners to get a site licence from the local authority before land could be used as a caravan site. Local authorities have powers to impose conditions in site licences and enforce them if breached.
The types of conditions that authorities may impose relate to the number of caravans allowed on the site, spacing between the vans and the provision of amenities on the site.

Caravan and Park Home Site Licensing
For licensing purposes a caravan is defined as 'any structure designed or adapted for human habitation which is capable of being moved from one place to another whether by being towed, or by being transported on a motor vehicle or trailer and any motor vehicle so designed or adapted'. The site must have been granted planning permission before you can apply for a camping or caravan site licence. Licences will not be issued to applicants who have had a site licence revoked within three years of the current application. You are only required to pay a fee for this licence if your land is to be used as a park for residential caravans. These sites are permanent residential sites which have planning permission to have residents living there as their main residence throughout the year. Both online and paper applications must include a site plan at showing the boundaries of the site, the positions of caravan standings and, where appropriate, the position of roads and footpaths, facilities, fire points and parking spaces.

The Act was based on a report by Sir Arton Wilson on problems of people living in caravans, which found that the principal problem was the unclear and insufficient legislation on the matter, which gave neither local nor planning authorities powers to deal with caravan housing. The Act requires occupiers of land to gain a license before using that land as a caravan site, with the licensing authority being the local borough or district council. The Caravan Sites and Control of Development Act prohibits the use of land a caravan site unless the occupier holds a site licence issued by the Council.

If you are considering buying a mobile home, it is at least as important as when buying a house that you ensure you do the right due diligence checks, and we would advise you to use a solicitor to help you with this. Please note that Arun District Council cannot recommend individual solicitors but it is important to engage a solicitor with knowledge of park home law because it is substantially different to the conveyancing of bricks and mortar property. There are also factsheets on buying and selling a home at the gov. The following leaflet provides advice on fire safety precautions: Fire Safety protect your caravan or mobile home from fire.
